Nolan et al. v. City of Los AngelesCase SummaryJackson DeMarco Tidus Peckenpaugh ("JDTP") represents the 36 plaintiffs, consisting of Los Angeles Police Sergeants, Lieutenants and Detectives, in the Fair Labor Standards Act (“FLSA”) overtime case Nolan, et al. v. City of Los Angeles, U.S. District Court Case No. CV 03-2190 GAF (AJWx). The Nolan case involves claims by peace officers against the City of Los Angeles for unpaid compensation and penalties under federal law for regular and overtime hours worked performing pre-shift and post-shift activities and missed meal periods. The officers contend that the Los Angeles Police Department (“LAPD”) required them to work overtime without compensation in violation of the FLSA. The suit asserts that the 36 LAPD officers have regularly worked overtime without compensation; that the LAPD has an “unwritten policy” discouraging the reporting of overtime work for less than an hour’s time; and that the department’s supervisors were aware of such practices. The Nolan case Complaint was filed on March 27, 2003 and the City of Los Angeles filed its Answer to the Complaint on June 20, 2003. The United States District Court denied the City's Motion for a Summary Judgement to dismiss the case on January 23, 2007. Related CasesAlaniz et al. v.
