Batts et al. v. City of Los Angeles

Case Summary

Jackson DeMarco Tidus Peckenpaugh ("JDTP") represents 10 named Plaintiffs in Batts v. City of Los Angeles, et al. U.S. District Court Case No. SACV06 – 843 CJC (RNBx). Batts currently remains a potential class action, consisting of Plaintiffs from the Nolan and Alaniz FLSA actions. The lawsuit seeks redress for retaliatory actions the City of Los Angeles and other named defendants imposed on members of the Nolan and Alaniz lawsuits. The retaliation alleged in the Complaint includes officers being passed over for promotions, subjected to administrative transfers, intimidation and bad ratings reviews. The Plaintiffs brought the suit to halt further retaliation and remedy passed damages.

The Batts Complaint was originally filed on September 8, 2006, and a First Amended Complaint on December 4, 2006. The Defendants filed a 12(b)(6) Motion to Dismiss, and the Court scheduled a hearing on that motion for March 5, 2007.
