Alaniz, et al. v. City of Los Angeles

Case Summary

Jackson DeMarco Tidus Peckenpaugh ("JDTP") represents approximately 2,200 LAPD Officers in the Fair Labor Standards Act (“FLSA”) overtime case Alaniz, et al. v. City of Los Angeles, U.S. District Court Case No. CV 04-8592 GAF (JWJx). The Alaniz case involves claims by current and former peace officers against the City of Los Angeles for unpaid compensation under federal law for regular and overtime hours worked performing pre-shift and post-shift activities, working through Code 7 meal breaks, in preparation for court appearances, work at home for the benefit of the LAPD. The donning and doffing of protective gear are included among pre- and post shift activities. The suit seeks compensation for LAPD officers holding the rank of Lieutenant and below for all work performed before and after the officers’ regularly scheduled shifts, interrupted meal periods and other activities that are routinely not compensated.

The Alaniz FLSA overtime case Complaint was filed on October 15, 2004, and a First Amended Complaint was filed on November 23, 2004. The City of Los Angeles filed its Answer to the First Amended Complaint on September 1, 2005. The Alaniz case was granted conditional status as a Collective Action on October 12, 2006.

The Alaniz lawsuit includes current and former Los Angeles Police officers who worked under the following circumstances:

  • Individiuals who are a current or former Los Angeles Police Officer, and
  • worked at least one (1) shift or deployment period at any time, from May 22, 2003, to the present while holding a rank of Lieutenant or below, including Sergeant, Detective or Patrol Officer; and
  • were unable to take an uninterrupted Code 7 lunch break during each shift and were not paid for the time spent working during the interrupted lunch break; and/or
  • worked any straight-time and/or overtime hours for which you did not receive straight-time compensation at your regular rate of pay or overtime compensation at the rate of one and one-half times your regular rate of pay for the time spent working “off-the-clock.”
